EBA and ESMA publish Guidelines on suitability assessment for management body members and key function holders

The European Banking Authority (EBA) and the European Securities and Markets Authority (ESMA) have published their joint Guidelines to assess the suitability of members of management bodies and key function holders.

These guidelines are issued pursuant to Article 16 of the ESA Regulations1. In accordance with Article 16(3), competent authorities and financial institutions shall make every effort to comply with the guidelines.

These guidelines set out appropriate supervisory practices within the European System of Financial Supervision and of how Union law should be applied.
